OWNERSHIP AND RISK

By proceeding with a purchase through our online store you give TEN TONES PTY LTD ACN 662 162 067 (TEN TONES), its contractors and agents authority to leave your item/s at the designated address should no-one be present to sign for it. Ownership and risk of damage of the goods passes to you upon delivery at your specified delivery address.

All items presented are in Australian dollar prices and are GST inclusive. All payments are processed in Australian dollars.

PROMOTIONAL CODES

Occasionally TEN TONES will offer promotional discounts in the form of discount codes. Please refer to the specific terms and conditions of any event for timeframe and exclusions.

Discount codes cannot be used in conjunction with any other offer.

AVAILABILITY

TEN TONES make every attempt to ensure the stock presented to you is accurate and available for purchase, however please note that our stock is not in real time and some discrepancies may occur. If in the event that our warehouse is not able to fulfil your order, you will be notified asap with an alternative option. If a suitable solution cannot be found a full refund will be processed.

TEN TONES may cancel your order without any liability to you if any of the products in your order are unavailable, or there were any errors in price or product description on the website at the time of placing your order, or due to technical errors in processing your order. If we cancel your order for any reason you will be given a full refund for any amount paid for the order.

You may be entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. If any guarantee, warranty, term or condition is implied or imposed in relation to these Terms and Conditions under the Australian Consumer Law or any other applicable legislation and cannot be excluded (Non-Excludable Provision), and TEN TONES is able to limit the remedy for a breach of the Non-Excludable Provision, then the liability of TEN TONES for breach of the Non-Excludable Provision is limited to one or more of the following at TEN TONES' option: (a) the replacement of the goods or the supply of equivalent goods; (b) the repair of the goods; (c) the payment of the cost of replacing the goods or of acquiring equivalent goods; (d) or the payment of the cost of having the goods repaired.

Despite any other provision of these terms and conditions and to the extent permitted by law (including the Australian Consumer Law), in no event shall we, our affiliates and related entities, our employees, directors or agents, or our suppliers be liable for loss of profits or anticipated profits or any punitive, exemplary, special, incidental or consequential loss or damages or the like arising out of or in connection with the website, the supply of goods or services or these terms and conditions (however arising, including negligence).
